Appeal Court Reverses Order Dismissing Abure and Others

The Court of Appeal in Abuja has overturned the judgment of the Federal Capital Territory High Court, effectively rescinding the restraining order against Julius Abure and two other individuals from serving as national officers of the party. 

The decision, which stems from an ex parte application ruled upon by Hamza Muazu on April 5, 2023, marks a significant turn in the protracted legal battle surrounding the leadership of the party.

Initially, the FCT High Court, presided over by Hamza Muazu, had issued a restraining order against Abure, Farouk Ibrahim, Clement Ojukwu, and Oluchi Opara, barring them from assuming their roles as national officers of the LP. 

Moreover, the court had dismissed objections raised by Abure contesting his removal as chairman of the LP.

The genesis of this legal saga traces back to a lawsuit filed by Martins Esikpali John, Lucky Shaibu, Isah Zekeri, Omogbai Frank, Abokhaiu Aliu, Ayohkaire Lateef, John Elomah, and Ayobami Arabambi. 

These plaintiffs accused Abure and his co-defendants of fabricating numerous documents from the FCT high court to effect unlawful substitutions in recent elections.

Undeterred by the initial ruling, the defendants swiftly sought recourse through the appellate process, mounting a vigorous challenge to the adverse judgment handed down by the lower court. 

Their persistence bore fruit when Justice Hamman Barka delivered the lead judgment on Wednesday, upholding their appeal and rebuking the jurisdictional overreach of the high court.

In a vindication of their legal stance, Justice Barka not only reversed the restraining order but also awarded a sum of N1 million in favor of the appellants, underscoring the gravity of the erroneous judgment rendered by the FCT High Court.
